Lady Berry Cupcakes reserve the right to alter our terms & conditions at any time.
Booking
Please choose the date you book a class carefully as refunds are not available for any Classes/Parties/Workshops/Zoom Classes/Private Tuition/Mentoring/Cupcake orders if you cancel or choose not to attend. You attend Lady Berry workshops & classes completely at your own risk, we will not be liable for any injuries, illness or accidents that occur during your class/workshop/ party or mentoring. We reserve the right to refuse your booking and cancel your booking at any time. By paying for a class either in full or as a deposit, you are agreeing to these Terms and Conditions.
On the rare occasion and of the ultimate discretion of Lady Berry Cupcakes a class may be transfred there is an admin fee of £15 to do so.
Refunds
Refunds are not available once payment has been made under any circumstances, even if the confirmation has not been sent out. Please check the dates and times carefully before you book. Classes are booked many months in advance and any late cancellations mean that a place may have been denied to another student. This applies to any class bookings, group bookings, Online classes, parties or gift vouchers.
All class bookings are bound by these terms and conditions at Lady Berry Cupcakes whether made online or via email. If you have class credit, under any circumstances, this is valid for 12 months only. Money or goods cannot be exchanged for class credit under any circumstances. It is advisable to take out insurance to cover any unforeseen events that may prevent you from attending your class at Lady Berry Cupcakes.
Photography & Video
During Lady Berry Classes & Workshops, we do take photographs and videos, you will be asked, if you’d prefer not to have your photo taken or used in any material, please let us know in advance. Lady Berry Cupcakes may use these photographs on our website or social media, but are not limited to these.
No photographs or videos are allowed to be taken by students during a Lady Berry Class. At the end of a class you are welcome to take photographs of your own work only. If you would like to use photographs of the cakes you have made in the workshop on Facebook, Instagram etc you are welcome to do so, but please ALWAYS credit them with a note saying that they were made with at Lady Berry Cupcakes class with a link to our webpage.
Class & Guide Content
We reserve the right to alter all online and in person classes, guides and workshop content at any time. All online classes and guides are fully non refundable. They are our own techniques and are not to be replicated for your own guides or classes.
Cupcake Parties & Workshops
A non-refundable deposit payment of is required to secure your date of a Lady Berry Cupcake Party. Once a deposit has been made unfortunately we are unable to offer a refund. Party date changes is only available on exceptional circumstances and is down to the descretion and availability of Lady Berry Cupcakes. If a date change is available it can only be changed less no later than 10 days before the date of your party. There is a Party date change fee of £50 due to loss of bookings.
The final non-refundable payment is required no less than 5 days before your Lady Berry Cupcake party. Final attendee numbers need to be finalised no less than 5 days before the party date along with the final balance.
Age
We do not allow under 16 years old in our adult classes. The class will be expected to run at a pace to enable us to fit in all the skills other students are paying for. With this in mind, the class needs students who can work at the pace required and not be distracted.
Family classes and workshop the minimum age is 5years to 15 years. The classes are for an adult and child to attend the class/ workshop together.
Online Teaching
All classes/ workshops and parties booked online are non transferable. You are welcome to take written notes during the class. Recording of online classes/ workshops & parties is strictly prohibited. Do not share these techniques with anyone. If you cant make the zoom class/ workshops or party on the scheduled date, there are no alternatives and you have missed your learning opportunity. Due to the limited people on a zoom/online course no refunds are available if you miss it.
All techniques will be fully demonstrated during the class. If you cant finish on time during the zoom class, you can take notes and complete your cake after the class has ended.
Only permitted guests are allowed to attend the Zoom classes and parties no others are permitted to join the class unless they have booked as a guest.
UPDATE – COVID-19 (Coronavirus) POLICY Group Classes
Lady Berry Class size will be a maximum of six students.
You will be asked to provide a photograph of yourself an a government approved lateral flow test by 7pm the evening before your class. If the test result is positive you will be asked to send someone in your place. No refund will be provided.
It will not be possible to social distance during some Lady Berry Classes Pending the governments regulations at the time of your class PPE Masks may be required for students, teachers. If you choose to wear a visor it must be worn with a mask. Airflow Depending on the weather and the comfort of students, the studio windows and door can be opened. Cleaning The studio, equipment and tools are cleaned with disinfectant before each class. You will be asked to sanitise your hands on arrival. Each student will have their own set of equipment for use in class and should only use their set of equipment provided.
If a class is cancelled beyond my control and no alternative is available, then you will be offered a voucher to use within the next 12 months or refunded in full on the day of your class booking. If you accepted a voucher but can’t find an alternative that suits your requirements, no refund will be available.
Gift Vouchers and refunds
We do not offer refunds on any gift vouchers purchased. Names can not be edited once the gift voucher has been created. Gift vouchers can only be used by the persons who’s name is on the gift voucher . They are valid for 12 months from date of purchase. Once a voucher expires, they then become invalid. They will not be extended under any circumstances. NO refund will be given on any voucher remaining after a purchase. NO cash or monetary value.
Cancellations
We strongly suggest you consider taking a policy to cover emergency cancellations, you can buy these from http://www.cancelsure-insurance.co.uk/.
In the very unlikely event that we have to cancel a class, workshop or party due to illness we will refund you in full with a gift voucher to book on a rescheduled date. We we not be liable for reimbursing any expenses or costs resulting from us cancelling a workshop or class, for example (but not limited to) travel. Lady Berry Cupcakes cannot be held liable for any money spent by students, such as travel, accommodation etc. If Lady Berry Cupcakes has to cancel a class and you have already made travel purchases, we would only be able to refund you for the price you paid for the class. Class Cancellation insurance is available to buy online which would cover you for these circumstances as mentioned above.
By booking your class/workshop/party with Lady Berry Cupcakes you accept that our liability is fully limited to the cost of the class. Lady Berry Cupcakes cannot hold class/ party places pending payment under any circumstances. If you do not log on for a class or have to cancel very last minute, you are not entitled to any class transfer, refund or voucher in any way. The class has been prepped, baked and stock has been purchased for your class place. If you do not come to your place booked, your money is lost. There are no circumstances where a voucher is given.
Weather conditions - If a class is cancelled due to adverse weather conditions, we will reschedule the class. If you can not attend the rescheduled date, you will be issued with a gift voucher to use at your connivence within a 12 month period of your voucher being issued.
Attendance
If you arrive more than 10 minutes late for your Lady Berry Class, you will be unable to join the class as you will be behind and this would be unfair to the other students. In this instance you would lose your booking and would not be able to transfer to a later date. Please ensure plenty of time when planning your journey.
All personal property brought into the classroom is done so at your own risk. We take no responsibility for lost, stolen or broken property while you are on our premises or after you have left the premises.
Discounts & Sales
From time to time, we announce discount sales on our classes. These are sales just like any other business and are available for customers and students who book a class during the sale period. The sale prices are clearly shown on the website. Classes booked before the sale starts and after the sale ends are not eligible for discounted rates. Similarly, classes booked before the sale starts and after the sale ends are not eligible for any discounts or refunds.
Intellectual Property
All content on Lady Berry Cupcakes website, Facebook page, Instagram, TikTok, Pinterest accounts and all other Lady Berry Cupcakes social media is the intellectual property of Lady Berry Cupcakes. By attending a course with Lady Berry Cupcakes you agree not to copy or imitate this content for your own commercial purposes following the course. This includes all Lady Berry Cupcakes designs, photography, course content, guide content and mentoring content.
If you run baking cake, cupcake, cookie classes yourself or plan on starting to host cake classes or workshops, you MAY NOT use the designs you have made during your class to promote your own classes or your business. It is absolutely forbidden to use any technique learnt with me during a class or online class or guide for your own teaching purposes. If this happens, you may be subject to legal action against you and your business.
You may not use designs Lady Berry Cupcakes lesson plans, class format, photographs, teaching techniques, pre class information, notes, wording or any other elements of the Lady Berry Cupcakes classes/workshop you attend for your own classes or the promotion of your own classes.
Online Video Classes & Guides
Terms and Conditions for Online Video Class School
The Terms and Conditions in 2020 govern your use of the School's services, including accessing and watching The Lady Berry Online video classes through our online platform Teachable. Please read these Terms carefully before using our School. By accessing or using our School, you agree to be bound by these Terms.
General Terms
1.1 Eligibility: You must be at least 18 years old or have the legal authority to enter into these Terms on behalf of a minor, to use our School. If you are accessing the School on behalf of a minor, you are responsible for supervising and monitoring their usage.
1.2 Account Creation: To access the School's classes, you may need to create an account on our Platform. You must provide accurate and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
1.3 Intellectual Property: All content provided through our School, including but not limited to video classes, materials, and resources, are protected by copyright and other intellectual property laws. You agree not to reproduce, distribute, modify, or create derivative works of any content from the Lady Berry Cupcake School for reteaching.
Use of the Platform
2.1 Access and Availability: You may access the classes on our Platform as long as the Platform exists and is operational. We reserve the right to modify, suspend, or terminate the Platform at any time without prior notice.

Fees and Payments
3.1 Fees: Access to the School's classes may be subject to payment of fees. The applicable fees will be clearly stated on our Platform. By accessing and using the School, you agree to pay the specified fees in a timely manner.
3.2 Payment Terms: Payments for our services are processed through secure third-party payment gateways. You agree to provide accurate billing information and authorize us or our payment processor to charge the specified fees to your chosen payment method.
3.3 Refunds: Unless otherwise stated, all payments made for the Lady Berry Cupcake School's classes are non-refundable.

Pricing
We reserve the right to alter our pricing at any time. Our prices are current at the time of bookings. We are under no obligation to issue a refund or gift voucher for any class booked outside an offer/discount we are holding.

On booking a class, party, workshop with Lady Berry cupcakes you as a customer understand that if a class, party, workshop is prevented due to acts of God, government restrictions, flood, fire. earthquake, epidemics or pandemics, shortage or adequate power or transportation facilities, embargoes, war, invasion, hostilities, riots or other civil unrest, strikes, labor stoppages or slowdowns, other industrial disturbances, or any other cause beyond the reasonable control of Lady Berry Cupcakes which makes it commercially impracticable, illegal, or impossible to hold the Lady Berry class, workshop, or party. Presentation of Lady Berry Cupcake class, party or workshop LADY BERRY CUPCAKES shall be responsible to the other party for failure or delay in performance of its obligations to conduct the Presentation oF the Event. Either party will immediately notify the other if the Presentation or Event cannot move forward as planned.
Customers agree to indemnify, hold harmless, and defend Lady Berry Cupcakes from and against any losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees and all other costs of defence, arising out of any third- party claim or threatened claim against Lady Berry Cupcakes arising out of any actual or alleged breach of the representations or warranties made by the customer on booking.
